Frenchy, I agree that students should be eligible for discounts for essential needs in regards to learning, I'm not denying that. With my point about the services and students, I'm referring to the fact that students generally receive a larger variety of discount in non-essential areas. Should a student really be given discount to spend their student loan on alcopops? I appreciate you may not have partied as much as the next person and have spent your money wisely and importantly, on items that are going to enhance your future, unfortunatley the same can't be said for a vast number of students. - That is partly the previous governments fault but that is a whole new ball park and thread! Furthermore, for a LAD clause to be enforceable, the requirement to pay under the clause must be a secondary obligation. The contractual obligation that has been breached is referred to as the primary obligation (e.g. failure to complete the works by the date specified in the contract) and the requirement to pay LADs is referred to as the secondary obligation because it is only triggered by a breach of the primary obligation. Put simply, a LAD clause must not be a stand-alone clause (or primary obligation) but a secondary obligation, otherwise it is likely to be unenforceable. LADs cannot be a penalty! It goes without saying that knowing what you will be expected to receive (as the Employer) or pay in damages (as the Contractor) should a breach occur, provides a level of certainty that is beneficial for both parties. If as the Contractor, you find yourself in the unenviable position of facing a claim by the Employer, there is a certain comfort provided by a LAD clause in that your liability will be limited - every cloud has a silver lining after all!
